台灣總會

國際特赦組織台灣分會(AIT)與國際執行委員會(IEC)共識之備忘錄(MOU)-1997

  升為正式分會後,台灣分會與國際執行委員會願意接受本備忘錄所列條文之約束,並在執行和監督上與IEC協商。本備忘錄需經台灣分會的理事會與國際執行委員會通過。本備忘錄條文須告知所有台灣分會會員。台灣分會的理事會與國際執行委員會須回覆台灣分會會員之詢問。

  台灣分會與國際執行委員會同意下列事項:

  1. 分會地位的承認:

      台灣分會是根據AI認定分會的原則升為正式分會。承認為正式分會時,AI對於領土的問題並無採取立場,而承認分會時也不表示對政府管轄權的支持或其它涵意。

  2. 中國(包括香港及澳門)的工作,考慮到海峽兩岸關係的敏感性會影響台灣,台灣分會將:
    • 不對中國(PRC),包括香港及澳門地區,作聲援人權活動;
    • 不對政府(包括中華民國ROC政府)及國際團體,作有關中國議題的遊說;
    • 不聲援來自中國的難民個案;
    • 不作個別的死刑案;
    • 不主動發佈有關中國的新聞,只有在反應時,亦即在被要求時才提供有關中國的AI資料和新聞稿。台灣分會不得自行發佈有關AI對中國的顧慮之聲明,並將所有媒體之訪問要求,轉介至國際秘書處IS(倫敦或香港辦公室)。

  3. 獨立性及公正性:

      台灣分會保證,台灣分會與其他民間團體合作將符合以上幾點原則,以及AI總會和民間團體合作的指導方針。

  4. 提供給所有AI分會資訊:

      IEC保證正式告知所有AI分會有關台灣分會的升等及以上所列要項。

  5. 分會認定的宣告:

      台灣分會與國際秘書處確保有關台灣分會升為正式分會的宣告,很明確的不是承認領土上的立場,或承認中華民國政府及其他含意。他們要強調這種決定是AI內部作業的程序,是針對會員及會務的發展,和台灣人權運動的成就的一種評估。

  6. 募款:

      有關主要的募款,台灣分會須與IEC及IS(倫敦或香港辦公室)協商」,特別是遵守總會的募款規則。


Memorandum of Understanding Between The Taiwan Section and the International Executive Council of Amnesty International

  As part of the Section status recognition process, the Taiwan Section of Amnesty International (AIT) agrees with the IEC to abide by the provisions of the present MOU and to consult with the IEC on its implementation and monitoring. This MOU will be agreed by the Board of AIT and by the IEC; members of AIT will be fully informed about its provisions. The Board of AIT and the IEC will respond to any query members of AIT may have about this MOU.

  AIT and the IEC agree the following:

  1. Section Status Recognition AIT is recognized as a Section in accordance with AI policies on Section Status which state that, when recognizing Sections, AI does not take any stand on issues of territoriality and that Section recognition does not imply support or otherwise for the jurisdictional claims of governments.

  2. Work on the Peoples Republic of China, including Hong Kong and Macao In view of the sensitivities involved in cross-strait relations affecting Taiwan, AIT will:
    • Abstain from campaigning on human rights issues and cases in the PRC, including Hong Kong and Macao;
    • Abstain from lobbying governments (including the Government of the ROC) and intergovernmental organizations on PRC issues;
    • Abstain from taking up cases of refugees in Taiwan from the PRC;
    • Abstain from campaigning on individual death penalty cases;
    • Abstain from carrying out media activities on the PRC other than reactive: that is, providing AI documents or news releases on request. AIT will not make any public statements on its own about AI's concerns in the PRC, and will refer all media interview requests to the IS (London or Hong Kong Regional Office).

  3. Independence and Impartiality AIT will ensure that cooperation between AIT and other NGOs is consistent with the above points and with AI s Guidelines on Cooperations with other NGOs.

  4. Information to the AI Movement The IEC will ensure that the AI movement is properly informed about the section status of AIT and about the points above.

  5. Publicity about Section recognition AIT and the IS will ensure that publicity about the recognition of AIT as a Section explicitly disavows any position on territorial issues and any recognition or otherwise of the Government of the ROC. They will make clear that recognition results from an internal AI procedure which is purely a measure of the development of the membership structure and of the success of human rights activism in Taiwan.

  6. Fundraising AIT will consult on major fundraising activities with the IEC, the HK Regional Office and the IS, in particular to check compliance with international guidelines on fundraising.
